Mitete Town Council has taken Vavika Trading Academy Limited to the Lusaka High Court, seeking the recovery of more than K1 million allegedly paid for skills training that was never delivered under the Constituency Development Fund (CDF) programme.
In its statement of claim, the local authority is demanding a refund of K1,083,050, which it says was paid to the academy to provide vocational and academic training to students sponsored by the council. The council is also seeking damages for breach of contract, arguing that the institution failed to honour its obligations.
According to court documents, Vavika Trading Academy Limited, which is registered in Southern Province, enrolled students from Mitete District in March 2024 under the council’s CDF-funded skills development initiative.
The council states that on March 11, 2024, a total of 65 students were confirmed as enrolled, after which the academy issued an invoice for their training. The full amount of K1,083,050 was subsequently paid by the council to cover tuition, registration, accommodation, meals, transport and other related services for the 2024 academic year.
“The defendant undertook to provide academic training for the students enrolled in various programmes, culminating in the award of a qualification or certificate,” the statement of claim reads.
However, the council alleges that the promised training was not delivered, prompting the legal action to recover the funds and seek compensation for breach of contract.
The matter is now before the Lusaka High Court, where the council is asking the court to order a full refund and award damages against the training institution.
